im just trying to remember what i've jsut remembered. have been stucked on the same bloody long chapter.Section 17: where there is a contract of sale of specific goods, the property them is transferred to the buyer at such time where the parties of the contract intended them to be transferred.
Section 18: rules for ascertaining the intention of the title passed to the buyer
#1: where there is a contract for the sale of specific goods in deliverable state, the property in the goods passes to the buyer when the contract is made.
#2: where there is a contract for the sale of specific goods, and the seller is bound to do something for the purpose of putting them in deliverable state, the property in the goods passes to the buyer when the thing is done and the buyer noticed that it has been done.
#3: where there is a contract for specified goods in deliverable state, but the seller is bound to measure, weigh, test or any other acts for the purpose of ascertaining the price, the property in the goods passes to the buyer when the thing is done and the buyer noticed it has been done.
#4: when goods are delivered to the buyer on approval, or on sale or return or other similar terms, the property in goods passes to the buyer:
-if he signifies approval or acceptance to the seller or does any other act adopting the transaction.
-if he does not signify approval or acceptance to the seller, but retains the goods without giving notice of rejection, then, if a time is fixed for return of goods, on the expiration of that time, and, if a time has not been fixed, on the expiration of a reasonable time.
#5: where there is a contract of sale of unascertained goods by description, and goods of that description and in deliverable state are unconditionally appropriated to the contract, either by the seller with the assent of the buyer or by the buyer with the assent of the seller, the property in the goods passes to the buyer. The assent can be express or implied and can happen before or after the appropriation is made.
that's only a small part pls. i still gt 3/4 of this chapter on laws relating to sale of goods and another 4 more chapts of LERM left.
